Terms of Service

These Terms govern access to BidPacto, including the RFP workspace, company profile, source-backed AI drafting, exports, and subscriptions processed through Polar.

Agreement

These Terms are a contract between you and BidPacto. By creating an account, signing in, uploading content, using the workspace, starting checkout, or otherwise using BidPacto, you agree to these Terms, the Privacy Policy, the Refund Policy, the Acceptable Use Policy, and any plan terms shown at checkout.

If you use BidPacto for a company or other organization, you represent that you are authorized to bind that organization. If you do not agree to these Terms, do not use the service.

Service

BidPacto is software for organizing RFP, RFI, DDQ, tender, security questionnaire, vendor questionnaire, and proposal response work. The service can ingest customer-provided files and text, generate source-backed draft answers, identify missing information, provide review status fields, and export draft materials.

BidPacto does not submit bids, sign proposal documents, make procurement decisions, guarantee award outcomes, or replace your legal, compliance, procurement, pricing, security, or subject-matter review.

Accounts

  • You must provide accurate account information and keep your sign-in method secure.
  • You are responsible for activity under your account and for each file, prompt, answer, note, export, and instruction submitted through your workspace.
  • You must promptly notify us if you believe your account or customer content has been accessed without authorization.
  • You may not share access in a way that bypasses plan limits, security controls, or billing requirements.

Customer Content

You retain ownership of RFPs, company profiles, uploaded source documents, extracted text, generated drafts, review notes, and other materials you submit or create in the service.

You grant BidPacto a limited license to host, process, transmit, display, and transform Customer Content only as needed to provide, secure, support, troubleshoot, and improve the service, comply with law, and enforce these Terms.

You represent that you have the necessary rights and permissions to upload and process Customer Content, including any personal data, confidential business information, buyer documents, proposal materials, or third-party content contained in it.

AI Output And Review

AI-generated output can be incomplete, inaccurate, outdated, or unsuitable for a specific buyer requirement. Output may include bracketed placeholders where company proof is missing.

You are responsible for reviewing the original solicitation, validating every factual claim, confirming pricing and legal commitments, obtaining required internal approvals, and deciding whether any output should be submitted to a buyer.

BidPacto is not legal advice, procurement advice, accounting advice, tax advice, financial advice, compliance certification, or a guarantee that a response is responsive, complete, non-infringing, or eligible for award.

Confidentiality

We will use reasonable administrative, technical, and organizational measures designed to protect Customer Content. We will not knowingly disclose your non-public Customer Content except to provide the service, use subprocessors, comply with law, investigate abuse or security issues, support the account, or with your direction.

You should not upload classified information, payment card data, protected health information, children's personal data, export-controlled technical data, or other regulated data unless you have confirmed in writing that the service and your plan are appropriate for that data.

Billing Through Polar

Paid subscriptions are processed through Polar checkout. Polar acts as merchant of record or reseller for transactions it processes, calculates and handles applicable transaction taxes where Polar is responsible for doing so, and provides order-related transaction support.

Plan prices, billing intervals, included limits, and taxes are shown before payment is submitted. Unless stated otherwise, paid plans are monthly subscriptions that renew automatically until canceled.

Your purchase may also be governed by Polar's buyer terms, checkout disclosures, privacy terms, and transaction support processes. We do not store full payment card numbers in BidPacto.

Cancellation And Refunds

You may cancel future subscription renewals through the billing flow made available in the app, Polar, or by contacting support. Cancellation stops future renewal charges but does not automatically refund prior charges.

Refunds are handled under the Refund Policy and through Polar. Refunds must be issued through Polar rather than through a separate direct payment to the buyer.

Acceptable Use

You must comply with the Acceptable Use Policy. You may not use the service for illegal, deceptive, abusive, infringing, high-risk, or payment-network-prohibited activity, including false proposal claims, bid fraud, collusion, unauthorized access, malware, or spam.

Suspension And Termination

  • We may suspend or terminate access if you violate these Terms, fail to pay, create security risk, create legal or payment-network risk, or use the service in a way that may harm BidPacto, Polar, other users, buyers, or third parties.
  • We may remove or restrict Customer Content if required by law, requested by a buyer with authority, or necessary to address security, abuse, infringement, or payment disputes.
  • You may stop using the service at any time. Account deletion and content deletion may be subject to backup, legal, tax, fraud-prevention, dispute, or security retention requirements.

Disclaimers

The service is provided as is and as available. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, and error-free operation.

We do not guarantee that AI output will satisfy an RFP, meet a buyer's formatting or compliance requirements, improve win rates, avoid disqualification, or be accepted by any procurement portal or buyer.

Limitation Of Liability

To the maximum extent permitted by law, BidPacto will not be liable for lost profits, lost revenue, lost opportunities, lost data, indirect damages, consequential damages, special damages, exemplary damages, or punitive damages.

To the maximum extent permitted by law, BidPacto's total liability for claims relating to the service will not exceed the amounts you paid to BidPacto through Polar for the service during the three months before the event giving rise to the claim, or USD 100 if you have not paid for the service.

Indemnity

You will defend, indemnify, and hold BidPacto harmless from claims, damages, liabilities, costs, and expenses arising from Customer Content, your use of the service, your submitted proposal materials, your violation of these Terms, your violation of law, or your infringement of third-party rights.

Changes

We may update these Terms from time to time. The updated date above shows the current version. Continued use after changes become effective means you accept the updated Terms.
